Division Description
The Division of Economic and Financial Opportunity (DEFO) assesses the eligibility of businesses for certification through the City's Minority and Women-owned Business Enterprise (M/WBE), Locally Based Business Enterprise (LBE), and Emerging Business Enterprise (EBE) Certification Programs, delivers services to help firms grow through government contracting, and oversees the compliance of citywide vendors with equal opportunity and MWBE utilization mandates.

The Division of Labor Services (DLS) is a unit within DEFO that enforces Executive Order No. 50 (E.O. 50), which requires that City contractors comply with federal, state, and local equal employment opportunity (EEO) mandates. This enforcement ensures that jobs created by New York City contracts and the Industrial and Commercial Abatement Program (ICAP) are available to all qualified individuals regardless of race, creed, color, national origin, sex, age, disability, marital status, sexual orientation, or citizenship status. In addition, DLS ensures that ICAP project recipients meet their obligations regarding participation in the City’s Minority and Women-Owned Business Enterprise (M/WBE) program.

Job Description:

Position Overview
SBS seeks a Chief Vendor Compliance Officer for Citywide Vendor Compliance who will report to the Deputy Commissioner of the Division of Economic and Financial Opportunity. The Chief Vendor Compliance Officer will ensure excellence and timeliness in the fulfillment of the Division of Labor Services’ mandates, including communicating operational, compliance obligations and determinations to governmental partners and vendors; managing the development, implementation and maintenance of policies, forms, tools, communications and systems to facilitate the unit’s work; managing and coordinating program teams; overseeing the work of vendors; tracking and reporting on unit performance; and advocating for needed resources, all in accordance with applicable federal, state, and local laws, rules and agency policies.

Key Responsibilities

Supervision and Management:
  1. Lead and oversee the operations and management of the Division of Labor Services, which currently consists of seven staff members.
  2. Supervise and ensure the team's effective management of vendor compliance with labor standards.
  3. Provide ongoing training and professional development opportunities to enhance team performance and expertise.
Compliance Oversight:
  1. Ensure timely, appropriate, and effective oversight of vendors' EEO compliance obligations when awarded city construction and supply and services contracts and throughout the contract or project term.
  2. Develop and maintain protocols for monitoring and tracking compliance metrics.
  3. Manage and review vendor-submitted reports and documents including employment reports, company policies, practices and procedures, and certified payrolls to ensure compliance with relevant laws.
  4. Inspect contractor records including and job sites for compliance.
  5. Conduct periodic Agency and vendor audits to identify and mitigate compliance risks.
  6. Recommend actions for non-compliant vendors, including, but not limited to, contract suspension or termination, and enforcing corrective measures (e.g., employment programs to remedy non-compliance).
  7. Develop detailed action plans for corrective measures to ensure swift resolution.
  8. Ensure the disapproval of final contract payments when necessary.
  9. Collaborate with legal and procurement teams to ensure due process in compliance actions.
  10. Conduct periodic review of programmatic rules and policy for updates and alignment with changes in the procurement community/landscape.
Collaboration and Communication:
  1. Manage and maintain clear communication with city agencies whose vendors are covered by Executive Order 50 and the ICAP MWBE program.
  2. Facilitate regular updates and informational sessions to ensure alignment across agencies.
  3. Ensure proper communication with vendors regarding compliance requirements and non-compliance issues. Develop accessible resources and tools to assist vendors in meeting compliance standards.
  4. Act as a liaison between DLS/SBS and other divisions, such as legal, procurement, communications, and intergovernmental affairs.
  5. Coordinate with external agencies, such as the Office of Administrative Tribunals and Hearings (OATH), the NYC Commission on Human Rights, and state/federal regulators on labor compliance matters.
Policy, Systems and Resource Management:
  1. Lead the development and implementation of policies, forms, tools, and communication systems that facilitate vendor compliance oversight.
  2. Regularly evaluate these systems to ensure they remain relevant and effective.
  3. Track and report on the unit’s performance in meeting its objectives and obligations.
  4. Utilize data analytics to identify trends and areas for improvement.
  5. Monitor changes in regulatory requirements and adjust division policies accordingly.
  6. Advocate for necessary resources to support the work of the Division of Labor Services.
  7. Ensure the division's operations align with applicable federal, state, and local laws, rules, and agency policies.
The Chief Vendor Compliance Officer's work is guided by key legal frameworks and policies for the Division of Labor Services including:
  1. NYC Charter, Chapter 56, Section 1305
  2. NYC Administrative Code, Section 11-278
  3. Rules of the City of New York, Chapter 66, Section 10-01 through 10-13
  4. Executive Order 50
Minimum Qualifications
  1. A master's degree from an accredited college in economics, finance, accounting, business or public administration, human resources management, management science, operations research, organizational behavior, industrial psychology, statistics, personnel administration, labor relations, psychology, sociology, human resources development, political science, urban studies or a closely related field, and two years of satisfactory full-time professional experience in one or a combination of the following: working with the budget of a large public or private concern in budget administration, accounting, economic or financial administration, or fiscal or economic research; in management or methods analysis, operations research, organizational research or program evaluation; in personnel or public administration, recruitment, position classification, personnel relations, employee benefits, staff development, employment program planning/administration, labor market research, economic planning, social services program planning/evaluation, or fiscal management; or in a related area. 18 months of this experience must have been in an executive, managerial, administrative or supervisory capacity. Supervision must have included supervising staff performing professional work in the areas described above;
  2. A baccalaureate degree from an accredited college and four years of professional experience in the areas described in 1 above, including the 18 months of executive, managerial, administrative or supervisory experience, as described in 1 above.

  9. Familiarity with NYC procurement rules and procedures for navigating contracts and vendor relationships.
  10. Strategic thinker with exemplary execution skills to align division objectives with practical applications.
  11. Superior project and partnership management skills with experience managing multifaceted projects from inception to completion, ensuring they stay on schedule and within budget.
  12. Demonstrated ability to evaluate current processes and recommend solutions that streamline operations and improve productivity.
  13. Proven success in driving continuous improvement initiatives.
  14. Proficient in leveraging project management tools, data analysis software and other technologies to increase workflow efficiency.
  15. Familiarity with emerging technologies to enhance compliance oversight.
  16. A master’s degree from an accredited graduate school and ten years of full-time professional experience in a related field, at least three of which have been in a managerial capacity or in supervising personnel performing compliance oversight functions.
